Board of Zoning & Appeals

 

The Board shall have the power to hear and decide appeals from actions taken by the municipality's administrative offices and employees with respect to the municipality's building and zoning regulations. The Board may not approve exceptions to and variations from the municipality's building and zoning codes and regulation in individual cases except as may be required to afford justice and avoid unreasonable hardships to property owners. The standards to be applied by the Board in all instances shall be established by ordinance or resolution of the Council.

The Board of Zoning and Building Appeals shall establish its own rules of procedure and keep a record of its proceedings in all matters coming before the Board. No motion or other action overruling an action under the Zoning Ordinance by any administrative officer of the municipality shall be adopted except by an affirmative vote of at least five members of the Board.

Membership

There shall be a Board of Zoning and Building Appeals consisting of seven citizen members appointed by Council to serve four-year overlapping terms of office.
